By using the site and the services available on it you are deemed to accept these terms and conditions. Career Studio (Scotland) Ltd may revise these Terms at any time by posting an updated version to this web page. You should visit this page periodically to review the most current Terms. The revised terms and conditions will be deemed to have been accepted by you if you continue to use the web site and our services.
Use of the site
Apprenticeshipsinscotland.com is for non-commercial use only. If you wish to make commercial use of the site, you must enter into an agreement with Career Studio (Scotland) Ltd to do so in advance. Please contact us for more information on Advertiser rates.
The information and services available on the site are provided for the sole purpose of individuals looking for employment opportunities and career information and for employers seeking to recruit staff.
All copyright, database rights and other intellectual property rights in the site and the material available on the site belongs to Career Studio (Scotland) Ltd or its third party suppliers. Use of the site does not give you any proprietary rights in such materials.
In these terms and conditions:
- ‘Client’ means any person, company, organisation or firm which purchases Services from us;
- ‘Order Form’ means an order for Services on a form provided by us (in any format);
- ‘Services’ means all recruitment products and services made available by us;
- ‘Contract Month’ means, in respect of any Order Form relating to the provision of Services for a specified period of months, the calendar month commencing on the start date specified in the Order Form and ending on the day before the same date in the next calendar month;
- ‘Contract Term’ means the full term specified in the Order Form.
Commencement of Services
We will not commence the provision of Services until the Order Form has been returned to us, in a form approved by us and confirmed by the Client by way of signature, e-mail confirmation, on-line form, or provision of purchase order number. In the case of Clients who purchase Services on terms that require pre-payment, Services will not commence until payment is received and cleared.
Prices are as specified in the apprenticeshipsinscotland.com media pack and are guaranteed for the period stated on the order form. Any discounts agreed are confidential and may not be disclosed by the Client.
A job posted on apprenticeshipsinscotland.com will remain live for one calendar month or such shorter time as we agree with the Client. Any extension of this time will be charged to the Client at a relisting rate.
All prices are liable to VAT. All invoices are payable within 14 days from invoice date. Late payment will entitle us to suspend provision of Services. Interest will be payable on late payments.
License to use Customer’s name, trademarks and logos
The Client agrees that Career Studio (Scotland) Ltd may use the Customer’s name, trademarks and logos (“IP-Rights”) for the purposes of providing the Services.
All advertisements, listings and supplied third party content are accepted conditionally upon being approved, and if not activated any monies paid will be refunded.
Job adverts go live after payment confirmation on apprenticeshipsinscotland.com within 5 normal business hours. While every effort will be made to insert advertisements at the time specified, no guarantee can or will be given for such insertion and no liability will be accepted for omissions or inaccuracies, or for any consequence arising there from, or for damage to or loss of any material supplied.
You will be notified by email when your job adverts have gone live.
Apprenticeships in Scotland do not actively seek employer leads but when we receive enquiries we act as a broker to link up employers with training partners. We reserve the right to charge a finder’s fee (plus VAT) per successful lead. A successful lead is considered qualified when the young person is signed up with the training partner; following confirmation we will invoice for payment (confirmation can be from the employer, young person or training partner). If AiS pass an employer lead to more than one training partner it is the training partner’s responsibility to follow up with the employer and ultimately the decision is left with the employer to choose which training organisation would like to work with. Apprenticeships in Scotland do not accept any liability for provision of or success or otherwise of any leads.
Fair Use Policy
At Career Studio (Scotland) Ltd, we want all of our customers to get the best candidate attraction plans at the lowest possible price. This Fair Usage Policy (“FUP”) is designed to prevent fraud and abuse of our annualised agreements known as ‘contracts’ by a small number of users.
Subject to this FUP, Career Studio (Scotland) Ltd’s unlimited contracts allow unlimited job listings. Other unlimited services may also be included where stated at the time of purchase.
Career Studio (Scotland) Ltd’s contracts are for recruiter use only in accordance with our Terms and Conditions and this FUP (“Legitimate Use”). The following is a non-exhaustive list of practices that would not be considered Legitimate Use:
- Advertising jobs which are not for genuine, current, live opportunities with employers. We are guided by the Advertising Standards Agency rules for job advertising and specifically that “Employment ads relate to genuine vacancies” and The Conduct of Employment Agencies and Employment Businesses Regulations 2003, specifically Part 7;
- Using listings for general candidate attraction to attract a ‘pool’, unless specifically agreed and made clear on the listing;
- Reposting of listings to achieve a higher placing on the page list;
- Using listings for advertising other products and services;
- Re-selling of listings;
- Unusual listing patterns inconsistent with normal, contract use.
Other practices may be relevant in determining Legitimate Use and Career Studio (Scotland) Ltd reserves the right to take any unlawful, prohibited, abnormal or unusual activity into account in making its determination. Career Studio (Scotland) Ltd may at its option, terminate its relationship with you, or may suspend your contract immediately if it determines you are using your contract contrary to this FUP or Term and Conditions. Where reasonable, Career Studio (Scotland) Ltd will provide you with notice of improper usage before suspension or termination of your contract and, if appropriate, Career Studio (Scotland) Ltd may offer you an alternative subscription.
If your business needs significantly change during your contract period Career Studio (Scotland) Ltd may re-negotiate the details of your contract with you which may include changes to the payment amount.
Advertisements which appear to discriminate on grounds of sex, race or disability are illegal and may result in proceedings being taken against both the advertiser and the publisher. Advertisements are accepted by apprenticeshipsinscotland.com on the basis that the advertiser confirms that any requirement or qualification which may appear to discriminate illegally is in compliance with any exemption available under the relevant legislation. Notwithstanding this confirmation, if we nonetheless believe that an advertisement may be discriminatory we may at our discretion either amend the advertisement or remove it from apprenticeshipsinscotland.com without liability to you to make any refund of amounts paid or due to be paid in respect of the posting or otherwise and will inform you accordingly.
If you are an employment agency or an employment business (as defined by the Employment Agencies Act 1973) it is your responsibility to ensure the advertisements you place on apprenticeshipsinscotland.com comply with the Conduct of Employment Agencies and Employment Businesses Regulations 2003.
Career Studio (Scotland) Ltd reserve the right to alter, modify, suspend or cancel any advertisements at any time without notice. Advertisements are accepted only on condition that the advertiser warrants that the advertisement does not in any way contravene the provisions of The Trade Descriptions Act, 1968, or the Business Advertisements (Disclosure) Order, 1977, or the Consumer Credit Act, 1974, and complies with the British Code of Advertising Practice. The placing of an order shall be considered as acceptance of these conditions.
Responses to advertisements
We do not guarantee any response to your advertisement or that responses will be from individuals suitable for the job advertised. Services and information provided on the site by us and our third party suppliers are intended to assist in the recruitment process. Neither we nor our third party suppliers can guarantee the prospects of success in any particular case.
Content and links
If your advertisement links to another site via our external apply online option, you are responsible for maintaining the links and for the content of your advertisement and the linked site. Job advertisements contained on the site are provided by prospective employers and their agents. We accept no responsibility or liability for the contents of advertisements.
Third party sites
Vacancies you post on apprenticeshipsinscotland.com may also appear on third party recruitment web sites.
Usernames are for the sole use of the person to whom they are issued. Passwords must be kept confidential and secure. We may deny access to a username if we reasonably believe that it is being used by an unauthorised person or that the user is breaching these terms and conditions.
We try to ensure continuous availability of the site and all the services available on it but accept no responsibility for the consequences of interruptions or delays, however caused. We may, additionally, alter the design and specification of the site at any time.
Limitation of liability
Our liability, and the liability of our third party suppliers, for any loss or damage suffered by you as the result of your use of this site is limited to your actual direct damages and, except in the case of fraud, excludes any loss of future earnings, profit or prospects or any consequential or speculative loss. As required by law, this exclusion does not extend to death or personal injury caused by our negligence.
